Do I have to have the game Rock Band to buy tracks from Xbox Live Marketplace?

I have a guitar hero guitar for xbox 360 but I do not have either Rock Band or Rock Band 2 Discs. Can I still download tracks from the Xbox Live Market place for Rock Band? How do they save? To the hard drive?
